Defining the Field in an EB-1A Petition

The field determines who the applicant is compared with and what the evidence must prove.

Why the field matters

Extraordinary ability is not measured in the abstract. USCIS evaluates acclaim within a field of endeavor. A field drawn too broadly may create an artificial comparison with unrelated professionals. A field drawn too narrowly may look manufactured to eliminate meaningful peers.

Use the record to define it

The strongest definition grows from the applicant’s work: professional roles, technical methods, audiences, publications, clients, and recognized contributions. The petition should explain the common thread connecting those activities, especially when the applicant works across industries or disciplines.

Keep the future work connected

Defining the field also establishes the point of reference for the applicant’s proposed work in the United States. The applicant must intend to continue work in the area of extraordinary ability. Current USCIS guidance recognizes that a person may change occupations while remaining within the same area of expertise when the record explains the connection. The petition may make that connection concrete rather than relying on labels.
