Who Qualifies for an EB-1A Visa?

The EB-1A category rewards demonstrated acclaim, not professional promise alone.

The governing standard

EB-1A classification is available to a person of extraordinary ability in the sciences, arts, education, business, or athletics. The applicant must show sustained national or international acclaim, recognition of achievements, an intention to continue working in the area of expertise, and prospective benefit to the United States. A job offer and labor certification are not required.

What the evidence must accomplish

A strong petition does more than collect impressive documents. It defines the field, identifies the applicant’s standing within it, and explains why independent recognition distinguishes the applicant from accomplished peers. Awards, press, judging, original contributions, authorship, leading roles, and compensation may each prove part of that case.

The practical question

The central inquiry is whether the record, considered as a whole, places the applicant among the small percentage at the top of the field. Meeting individual criteria opens the door to that inquiry; it does not end it. The petition should therefore connect each exhibit to a coherent account of acclaim, influence, and continued work.
