A strong claim involves more than proving that someone was injured and another party was responsible. It also requires a realistic assessment of the insurance coverage and other resources available to satisfy a recovery.
Coverage is a separate inquiry
Different policies may apply depending on the circumstances: automobile coverage, commercial policies, homeowner’s policies, uninsured or underinsured coverage, and coverage connected to a business or property. The existence and limits of a policy can affect the strategy, documentation, and timing of a case.
Early review prevents surprises
Coverage questions should be addressed early, not after extensive work has been done. Policy language, exclusions, notices, and the relationship between multiple policies can matter. A person may have coverage that is not obvious from the first accident report, or may face limits that require careful decisions about how the claim is presented.
Liability, damages, and collectability are different parts of a case. A thoughtful evaluation considers all three.
